
The Digital Personal Data Protection (DPDP) Act 2023 in India is now fully implemented with its rules. The government notified its rules on November 14. These rules will strengthen the privacy of common people, as well as promote innovation and the digital economy. The DPDP Act was passed by Parliament on August 11, 2023. It defines the responsibilities of companies handling digital personal data (data fiduciaries), while giving people their rights. Parental consent required for data of children and persons with disabilities For children, parental consent is mandatory for using their data in any form. Exemptions will only be granted in essential cases such as healthcare, education, or real-time safety. For persons with disabilities who cannot make legal decisions, consent must be obtained from their legal guardian, who is verified under the law. 5 most important things about the DPDP Act What will happen to data breaches and complaints? If personal data is breached, the data fiduciary must immediately inform the affected people in plain language. Such as – the nature of the breach, its potential impact, what steps should be taken, and whom to seek help from. People have been granted rights – to access, correct, update, or erase their data. Nominees will also receive these rights. All requests must be responded to within a maximum of 90 days. For complaints, the Data Protection Board will be digital, allowing filing and tracking through an online platform and mobile app.
